Terms and Conditions

1. Scope and contracting party

These General Terms and Conditions (terms) govern the use of ELANUM (soulresonance.ch, web app and related services). Your contracting party is maind GmbH, Grütstrasse 13, 5200 Brugg, Switzerland ("we").

By registering or using ELANUM you accept these terms and the community guidelines and take note of the privacy statement. For coaches, practices, companies, event organisers and API customers, the conditions you confirm in the respective area apply in addition; in case of conflict they take precedence for their area.

2. The areas of ELANUM

• Public pages and calculators (for example Soul Blueprint, Synergy Resonance, knowledge, method): usable without an account.
• Soul Kosmos (self-discovery): portrait, daily impulse, questionnaires, circle with contacts, dossier, cycles, reflections and further tools. Requires an account and a minimum age of 18.
• Resonances (dating): suggestions, likes, matches and chat. Requires an account, a minimum age of 18, activation and residence in: Switzerland.
• Portals for coaches, companies and event organisers with their own conditions.

3. Account and registration

• You must be at least 18 years old and have capacity of judgement.
• Your details must be true, in particular first name, date, time and place of birth, as they form the basis of the calculations. First name, date of birth and place of birth are locked after registration and corrected only on a justified request.
• Each person may hold only one account. The account is personal and not transferable.
• You keep your sign-in means (email inbox, passkeys, devices) secret and secure. You are responsible for actions taken through your account to the extent you are responsible for their misuse. Report any suspected misuse to us immediately.
• We may refuse a registration or activation without giving reasons, in particular in the dating area, where a person reviews new profiles.

4. Services

ELANUM calculates astrological, numerological and Human Design profiles from birth data, evaluates questionnaires and composes texts for self-reflection from them. In the dating area we suggest profiles to other users and enable exchange. You can see the current range of features in the application itself.

• Many features of ELANUM are free of charge. We offer individual features as a paid subscription or a single purchase. You see the price, term, renewal and cancellation before you buy; a purchase is only concluded once you expressly confirm it. If a previously free feature becomes chargeable, we announce this in advance; this never applies retroactively. Referrals do not currently grant automatic additional feature access or financial entitlements.
• Voluntary donations via the support page do not change the range of features and do not create any claim to a service in return.
• To protect the servers, the creation of PDF dossiers is limited to 10 per rolling 7 days and account. We may set and adjust other usage limits.
• We may extend, change, restrict or discontinue features where this is reasonable for you, for example for technical, legal or security reasons. There is no claim to a particular range of features.

5. What our content is and what it is not

Please read this section carefully. Astrology, Human Design and numerology are systems of interpretation, not scientifically proven methods. Our content, including portraits, daily impulses, dossiers, questionnaire results and compatibility scores, serves exclusively self-reflection, inspiration and entertainment. How we calculate and where the limits lie is described on the Method page.

• Our content is no substitute for medical, psychiatric, psychological or psychotherapeutic diagnosis, advice or treatment, for legal, tax or financial advice or for advice on parenting or family matters.
• We make no diagnoses and give no promises of healing, success or relationships. A compatibility score says nothing reliable about whether a relationship will succeed.
• We give no warranty that calculations, interpretations and texts are correct, complete, current or suitable for your purposes. Calculations depend on the accuracy of your details; an inaccurate or unknown time of birth changes results considerably.
• You make your decisions on your own responsibility. Do not base decisions about health, relationships, children, work or money on our content alone.
• Do not stop or start any medically prescribed treatment because content from ELANUM might suggest it.

6. If you are not doing well

Some content touches on topics such as hurt, attachment, separation or grief. If you are in a crisis or are thinking about suicide, please contact one of the following services immediately. Support is free and confidential:

ELANUM is not a crisis service. Our support is not set up for emergencies.

7. Ongoing development

The offer is continuously being developed. Features and texts may therefore change, and new features may initially contain errors. To test features and calculations and in the demo mode of the dating area, we use test profiles; they do not represent real people. Test profiles visibly carry the badge "Test profile · AI image". The pictures of test profiles were generated with artificial intelligence and their replies in the chat are prepared texts. In live mode you see no test profiles. Accounts from the early period carry the status "Founding Soul" as a token of appreciation.

8. Conduct on the platform

The community guidelines apply to all areas. In particular, you undertake:

• to treat others with respect and not to harass, threaten, insult, discriminate against or expose anyone,
• not to send sexual content without explicit consent, not to upload nude images and never to distribute sexual content involving minors,
• not to use false identities, other people's photos or fake profiles,
• not to distribute advertising, chain letters, solicitation for financial schemes, fraud attempts or requests for payment,
• not to access the platform by automated means (bots, scrapers), not to circumvent technical protection measures or usage limits and not to reverse engineer the platform,
• not to distribute content that infringes the rights of third parties (for example copyright or personality rights) or applicable law.

9. Your content

• You are responsible for content you upload or write (texts, pictures, voice recordings, messages). You confirm that you hold the necessary rights and that people shown have agreed.
• Dating profile pictures must show you, be current and contain no nudity.
• Organisers warrant that they hold the necessary rights to the image, texts, registration link and contact address of their events and to their organiser page; we show this content to signed-in members together with the event and remove it when the event or the account is deleted.
• You grant us the simple, free right, limited to the duration of storage, to store your content, adapt it technically (for example resize it) and display it as you set in your settings. We acquire no further rights; in particular we do not use your content for advertising outside the platform.
• We may review, hide or remove content that violates these terms, the community guidelines or the law, or where there is a justified suspicion of this.

10. Data about other people

In your circle, in Synergy Resonance and in the dossier you can enter details about other people, for example your partner, family, children, friends or people from work. The following applies:

• For a contact we store the first name, voluntarily the last name, the gender, the type of relationship, the date of birth, voluntarily time and place of birth, voluntarily a photo and your assessments. If the contact takes part via a guest link, the details they enter themselves are added. Details are in the privacy statement.
• You enter only people whose details you know lawfully and use the results only for yourself. This applies to all contacts. You do not publish the results and do not use them to judge, monitor, pressure or disadvantage anyone, for example in job applications or in separation and custody matters.
• Where necessary, you obtain the consent of the person concerned or inform them. This applies in particular when you enter their email address for an invitation.
• Protective rules that cannot be switched off apply to contacts under 18 (privacy statement section 4.5).
• If a person who has been entered asks us for access or erasure, we may delete the details about them after review.
• If you breach these obligations and we are held liable for this by the person concerned or an authority, you indemnify us, to the extent permitted by law, against the resulting claims and reasonable costs of legal defence, insofar as you are responsible for the breach.

11. Dating: meetings on your own responsibility

• We review new dating profiles by hand, on a sample basis or in full, but we do not carry out identity, criminal record or background checks. A verified badge only confirms that at the time of review the person resembled their profile pictures and showed the requested gesture.
• We cannot guarantee that other users' details are true or that others follow the rules.
• Meetings with other users take place on your own responsibility. Meet first in a public place, tell someone you trust where you are, do not hand over money or bank details and report suspicious behaviour.
• You can block and report any person at any time. We review every report (section 12).

12. Reports, moderation and suspension

• You can report illegal content and violations of the community guidelines via "Report" in a profile or chat, through support or, even without an account, by email to contactk‍o‍s‍m‍o‍s@soulresonance.ch. How we handle reports is described in the community guidelines.
• Depending on severity, we may remove content, issue a warning, restrict features, pause dating mode, suspend or delete an account temporarily or permanently and inform authorities. We take the circumstances of the individual case into account and give reasons for our decision unless the law requires otherwise or doing so would create a danger.
• In the case of serious violations, in particular violence, threats, sexual harassment, fraud or any suspicion of exploitation of minors, we suspend immediately and without notice.
• You can object to a decision through the form under "Feedback" or by email; a person reviews it again.

13. Termination and deleting your account

• You can end the contract at any time by deleting your account under "Account". The consequences for your data are described in the privacy statement.
• We may terminate the contract with 30 days' notice, for example if we discontinue an area, and without notice for good cause, in particular in the case of serious violations.
• Paid services already provided at the time of termination remain payable.

14. Intellectual property

Texts, interpretations, calculation models, graphics, design and software of ELANUM are protected by copyright or otherwise and belong to us or our licensors. For personal, non-commercial use you receive a simple, non-transferable right of use; you may store your own dossier privately and share it with people you trust. Any further reproduction, publication, commercial use and any automated extraction (scraping, training of AI models) requires our prior written consent. Commercial use by coaches and advisers is possible via the For coaches page.

15. Availability

We strive for operation with as few interruptions as possible but owe no particular availability. Maintenance, further development, security measures, disruptions at third parties (for example hosting, network, email delivery) and force majeure may temporarily restrict access. Keep content that matters to you yourself; under "Account" you can download all your data at any time.

16. Liability

• We are liable without limitation for damage we cause intentionally or through gross negligence and for damage from injury to life, body or health, insofar as the law does not permit a limitation. Mandatory liability under the Product Liability Act and other mandatory provisions remains reserved.
• Otherwise our liability for slight negligence is excluded to the extent permitted by law. This applies in particular to indirect and consequential damage, lost profit, data loss, damage from decisions you make on the basis of our content, and damage from the conduct of other users, from meetings with them or from third-party content.
• For free services we are liable only for intent and gross negligence, to the extent permitted by law.
• Liability for auxiliary persons (Art. 101 Swiss Code of Obligations) is excluded to the extent permitted by law.
• Where we must be liable for slight negligence in paid services, liability is limited to the foreseeable, typical damage and at most to the amount you paid us in the twelve months before the event causing the damage.
• For people habitually resident in the EU, the EEA or Liechtenstein, these limitations apply only insofar as the mandatory consumer law of their country of residence permits them. Where it does not permit excluding liability for breach of essential contractual obligations, we are also liable for this in the case of slight negligence, limited to the foreseeable, typical damage.

18. Changes to these terms

We may amend these terms if the offer, the legal situation or the security situation changes. We inform registered users of material changes at least 30 days before they take effect by email or in the app. If you do not agree, you can delete your account free of charge before they take effect. If you continue to use ELANUM after they take effect, the new terms are deemed accepted; we point this out in the notice. Changes that require new consent or bring new costs apply only with your express agreement.

19. Applicable law and place of jurisdiction

Swiss law applies, excluding the rules of private international law and the Vienna Sales Convention. The place of jurisdiction is Brugg, Switzerland. If you act as a consumer, mandatory places of jurisdiction in your favour remain reserved (in Switzerland Art. 32 Civil Procedure Code). If you are habitually resident in the EU, the EEA or Liechtenstein, you also retain the protection of the mandatory provisions of the law of your country of residence, and you can sue at your place of residence and can be sued only there.

We do not take part in dispute resolution proceedings before a consumer arbitration board and are not obliged to do so. If there is a problem, please contact us first; we will look for a solution.

20. Final provisions

If any provision of these terms is invalid, the remaining provisions remain valid. The statutory rule replaces the invalid provision. These terms are available in German and English; in case of discrepancies the German version prevails, unless mandatory law provides otherwise.
